I. Basic Concepts.
Art. 1. “Website/Site” – the website www.bulgariatravel.org, located at the web address: www.bulgariatravel.org, including its subdomains and/or directories, which represents a specific location on the Internet, accessible through its unique web address, containing various information, such as files, images, multimedia, texts, sounds, data bases, other subjects of intellectual property, etc.
Art. 2. “MEET” – The Ministry of Economy, Energy and Tourism, unified identification code: BG 130169256, with headquarters and registered address: 1052, Sofia City, 8 Slavyanska Str.
Art. 3. "Services, offered on the site” – The services, offered on the internet site www.bulgariatravel.org, are divided into services related to the use, for which the respective user needs to have a preliminary registration, and services, for which the user does not need to have a registration. The services, for which no registration is needed, are: watching real time web cams, video archive, picture galleries and articles for tourist sites and attractions from the multimedia catalogue of the site, current news, weather forecast, information about tourist sites and attractions from the multimedia catalogue of the site, general information about Bulgaria – state structure and economy, geographic location, history, nature, lifestyle and culture, information about cultural events, calendar of cultural events, virtual map, useful links, important information, информация за туризма в България, information about туроператори, hotel keepers, tourist agencies, etc. нормативна уредба, събития за бизнеса, новини, обяви и съобщения, printed materials, advertising and information brochures. The appearance, the number and the nature of the offered services can be changed unilaterally by the MEET, entirely based on their judgment, without prior notice.
The services for which users need a preliminary registration include options for the registered users to publish materials, videos, pictures, routes and comments on the user pages of the website www.bulgariatravel.org.
Art. 4. “Materials” – audio-visual works, texts, comments, information, video materials and photographic images and other subjects of copyright and its related rights, created by users or with the participation of users, on which users have exclusive rights for use as of the moment of their providing for publishing on the site.
Art. 5. “Electronic Link” (or simply “link”) – a connection, marked in a specific Internet page, which allows automatic redirection to another Internet page, information resource or object, through standardized protocols. The MEET shall not be held responsible for the information content, presented in links (redirections) to other web sites or features of such sites, published in www.bulgariatravel.org. Due to the fact that it does not supervise these pages and features, the MEET shall not be held responsible for the information presented in them, for its validity, the allowed mistakes and inconsistencies, published there, as well as upon occurring losses, direct or indirect damages, as a result of using the latter.
Art. 6. “Internet Page” – an individual part of a web site or an entire website.
Art. 7. “User” – any person, who uses the services, provided on the site www.bulgariatravel.org.
Art. 8. “Abusive Acts” – unrightful use of the contents of www.bulgariatravel.org (texts, graphics, videos and other subjects of intellectual property), publishing of information and links to sites with pirate, racist or uncensored contents, publishing of information and materials, for which the user does not hold the copyright, hacking.
Art. 9. “Server” is a device or system of related devices, on which or on some of which software is installed for performing tasks in relation to storing, processing, acceptance or transferring or information.
II. Subject of the General Conditions.
Art. 10. The MEET through the website www.bulgariatravel.org provides users with the services stipulated in these general conditions, hereinafter referred to as “the Services”, as users are required to use the services only in conformity with the regulations of the present General Conditions.
Art. 11. The MEET provides users with an option to place materials on a server of the MEET, after performing a preliminary registration and creating a user’s profile.
Art. 12. In case users do not want to use the services, which provide them the option to publish materials on the site, no preliminary registration is needed.
III. General Regulations. Agreement with the General Conditions.
Art. 13. /1/ The entire content of the site www.bulgariatravel.org is an ownership of the Ministry of Economy, Energy and Tourism (MEET). Each use of the site content, including saving, copying, publishing, reproduction, distribution, wireless broadcasting, cable broadcasting and transmitting, publishing on the Internet, public presenting, processing of graphics, videos, text materials or other subjects of intellectual property from the site can be performed only with the explicit agreement on the part of the Ministry of Economy, Energy and Tourism (MEET).
/2/ All services on the site are accessible around the clock.
Art. 14. /1/ By entering the website, users declares that they wish to use the Site Services, that they are aware of the present General Conditions and that they are required to observe them.
/2/ The conditions for the registration as per Art. 11 are as follows: the following data are required from the user: email, password and username. Through pressing the Registration button, users agree with the conditions for using these services.
Art. 15. The MEET provides free of charge the use of the services on the website www.bulgariatravel.org.
Art. 16. /1/ The MEET publishes the present General Conditions on the site.
/2/ The MEET shall have the right to change unilaterally at any moment without prior notice the General Conditions, as well as the services offered on the internet site. The MEET shall not be held responsible for occurring losses, direct or indirect damages as a result of this.
/3/ In case that amendments are made in the General Conditions, the MEET shall notify the users, by publishing the amended General Conditions in the site.
IV. Conditions for Using the Site
Art. 17. Users shall be able to use free of charge the website www.bulgariatravel.org.
Art. 18. /1/ For using the services, which include placing of materials on a server of the MEET, users shall perform a preliminary registration.
/2/ Materials can be placed on a server of the MEET any time around the clock, as their visualization on the site www.bulgariatravel.org will follow only after an approval of moderators of the MEET. Comments and evaluations of materials shall appear on the site with the approval of a moderator, but the MEET shall have the right to remove contents, which violate the general conditions.
Art. 19. /1/ By pressing the Send button, users agree and transfers to the MEET the exclusive right to use multiple times the materials, in any possible ways, stipulated in the Copyright Act and its Related Rights (CARR), for the maximum allowed period, determined in the CARR and for the territory of the entire world.
/2/ The using includes, without being limited to: reproduction, distribution, wireless and satellite broadcasting, cable broadcasting and transmitting to other organizations, publishing (offering access) on the Internet, analog and digital distribution, distribution through mobile networks for transmission of contents, through the Internet and other platforms for distribution and through any other types of technical devices as parts of programs, belonging to the MEET, or to persons related to the MEET as per the meaning of the Commercial Act.
/3/ Users shall transfer to the MEET their right to use the materials uploaded on the site www.bulgariatravel.org in a way, which they consider to be appropriate, including for publishing on the Internet pages, owned by the MEET.
/4/ By pushing the Send button, users agree and transfer to the MEET their right to unilaterally determine whether the respective material will be distributed, as well as the time and the manner, in which this should happen.
Art. 20. Users agree that for the providing of materials and for the transferring of copyrights they shall not receive remuneration. The MEET shall not owe a compensation for the use of the contents by third persons.
Art. 21. /1/ When users publish materials, videos, pictures, routes and comments, they need to specify to the MEET the author of the materials and the holders of their related rights.
/2/ By pressing the Send button, users transfer to MEET all transferable non-property copyright and related rights upon the materials.
/3/ Users agree that with view to the materials and the manner of their using, the names of the authors and the holders of the related rights for them may not be specified upon their using.
Art. 22. Users agree that the MEET shall not be obliged to publish or use in any way the materials that users are sending.
Art. 23. Users agree that by pressing the Send button they agree that MEET shall collect electronically personal information for them, specified in Art.14, cl.2 and use it in relation to the use of materials as per the meaning of the present General Conditions.
Art. 24. By pressing the Send button, users declare that they fully understand the contents of the present General Conditions and they clearly agree to be legally bound by them.
Art. 25. /1/ The services, offered on the internet site www.bulgariatravel.org include real time watching of web cams, video archive, picture galleries and articles for tourist sites and attractions from the multimedia catalogue of the site, current news, weather forecasts, information about tourist sites and attractions from the multimedia catalogue of the site, general information about Bulgaria – state structure and economy, geographic location, history, lifestyle and culture, information about cultural events, calendar of cultural events, virtual map, useful links, important information, информация за туризма в България, information about туроператори, hotel keepers, tourist agencies, etc., нормативна уредба, събития за бизнеса, новини, обяви и съобщения, printed materials, advertising and information brochures, options for publishing of materials from users (videos, pictures and routes) and comments.
/2/ MEET notifies users that the authors who write in the blogs/user pages of www.bulgariatravel.org express their personal opinion in various topics and MEET shall not be held responsible for what they write.
Art. 26. MEET shall have the right to edit or delete comments, in case they contain:
1. uncensored words or expressions, as well as any form of insults, contradicting the good manners;
2. text which incite or inspire cruelty or violence or instill intolerance between citizens;
3. stimulate the use of drugs, alcoholic beverages, tobacco and tobacco articles;
4. demean the honor or dignity of someone or spread a disgraceful circumstance about someone, or accuse someone of committing a crime;
5. contain insults on religious grounds;
6. harm the good reputation of a particular person in society;
7. contain national, political, ethnic, religious, racial, sexual or other type of discrimination;
8. contain racist topics, agitation or incite towards racial deeds and/or insults towards minorities;
9. contain links to sites, which distribute illegally the contents of the site www.bulgariatravel.org and others, or links to sites, which contain comments as per the meaning of the previous clauses;
10. threaten the physical, mental or moral development of underage people;
11. disclose state, official, commercial secret or other secret, protected by law;
12. contain violations of the effective legislation of Republic of Bulgaria.
The application and interpretation of the previous clauses shall be performed entirely based on the assessment of the MEET.
Art. 27. MEET shall have the right to reject uploading on the site, edit or remove from the site video materials (video clips) or photographic images, which content is contradicting the regulations of the effective legislation of Bulgaria, as such, containing:
1. Sexual harassment;
2. Pornographic and vulgar naturalistic sexual scenes;
3. Children pornography;
4. Victims of car accidents and other incidents;
5. Violations of physical inviolability – upon life, health of people, violations of sexual inviolability and sexual morality;
6. Inciting or inspiring to cruelty or violence;
7. Materials stimulating the use of drugs, alcohol beverages, tobacco and tobacco articles;
8. Materials demeaning for the honor or dignity of someone or spreading a disgraceful circumstance about someone, or accusing someone of committing a crime;
9. Religious and antireligious agitations;
10. Insults on religious grounds;
11. Harming the good reputation of a particular person in society;
12. Disclosing state, official, commercial secret, or another secret protected by law;
13. Containing national, political, ethnic, religious, racial, sexual or other discrimination;
14. Containing racist topics, agitations or inciting towards racist acts and/or insults to minorities;
15. Abuse and acts of aggression or violence against animals;
16. Materials of acts of terrorism in any form;
17. Straightforward acts against school order and rules;
18. Destruction (in any form) of state or municipal ownership;
19. Containing acts which violate the effective legislation of Republic of Bulgaria as of the moment of uploading the respective material;
20. With poor technical quality, unclear view and contents, etc.
The application and interpretation of the previous clauses shall be entirely based on the assessment of the MEET.
Art. 28. By publishing comments and materials on the site and pressing the Send button users guarantee and declare that the comments and the materials do not violate the requirements of the effective legislation and the requirements of the MEET, described in Art. 26 and 27 of the present General Conditions, and that they take full responsibility in this respect.
Art. 29. The MEET shall have the right to deny access to the site to users, which systematically and consciously two or more times have violated the rights of the site.
Art. 30. /1/ The MEET shall not be held responsible for the content of the comments and the contents of the materials, placed by users on the MEET’s server.
/2/ In relation to the rights of use, provided by the users, and the declarations and warranties made by acceptance of the present General Conditions, users shall take full responsibility and shall release the MEET of all claims, made in a juridical or extrajuridical way, by authors and holders of related rights upon the materials, and upon possible making of such claims directly to the MEET, they will settle them entirely and to their own expense in case that the MEET establishes in an indisputable way, that they are well-grounded.
/3/ Users, with view to the responsibility brought by them about the content of the materials and comments published by them, and their lawful using as per the meaning of the present general conditions, shall bear at their own expense all occurring costs:
1. by claims made against the MEET in relation to violation of the regulations of the effective legislation in the comments and materials, including those for conducting the legal case and possible payment of a compensation to the harmed person, by proving according to the due order that the claim is well-grounded;
2. by administrative and penal sanctions, imposed by the competent body for violations of the applicable legislation in the materials and comments, including those of conducting the law case and possible payment of a property sanction.
Art. 31. The MEET shall not be held responsible, if due to technical or other reasons the respective materials had not reached them or had not been stored by them.
VI. Termination of Registration. Solving of Arguments.
Art. 32. Users can give up their registration in the site at any time. Users shall also continue being held responsible for the contents uploaded by them, even after their giving up of the registration.
Art. 33. /1/ Registration of a particular user can be terminated unilaterally by the MEET without prior notice, if:
1. The respective user violates the regulations of the effective Bulgarian legislation;
2. The respective user violates the present General Conditions.
In these cases the MEET shall have the right to terminate the user’s registration and delete all materials placed by them on the servers.
/2/ The registration of a particular user shall be terminated unilaterally by the MEET without prior notice, if the MEET decides that by placing of materials or comments on the site, the respective user had conducted a crime or an administrative violation. In these cases the MEET shall file information to the competent state authorities by providing them with the required assistance and the entire needed information and materials, claimed as per the due order, which would be of help for the identification of the doer and proving the committed crime or administrative violation.
